Terms & Conditions
These Terms and Conditions (the "Terms") govern your relationship with the operator of the online gambling service marketed as Kraken Casino and made available via the website located at crakeng.com (the "Website"). By accessing, registering an account on, or using any services on the Website, you agree to be bound by these Terms. If you do not agree, you must not use the Website.
The Website is operated by Kraken N.V., a company incorporated under the laws of Curaçao, which holds a sub-license under Master License No. 365/JAZ issued by Gaming Curaçao (sub-license GLH-OCCHKTW0703052021), with payment processing services in certain cases facilitated by an affiliated entity established in Cyprus (for example, "K-Services Ltd") acting as a payment agent only.
Important regulatory notice for UK residents: Kraken N.V. is not licensed by the United Kingdom Gambling Commission ("UKGC") and the Website is not part of GamStop, IBAS or any UK statutory dispute resolution scheme. If you access the Website from the United Kingdom, you do so on an offshore, grey-market basis, without the protections normally afforded to customers of UKGC-licensed operators. Nothing in these Terms affects any mandatory rights you may have under UK consumer law, but enforcement of such rights may be practically difficult against an overseas operator.
These Terms take effect from 1 January 2026 and were last updated on 6 November 2026. The operator may amend these Terms in accordance with the "Changes to Terms" section below.
Definitions
For the purposes of these Terms, the following expressions have the meanings set out below. These definitions are intended to provide clarity and must be interpreted together with the context of the Website and applicable law.
- Operator means Kraken N.V., the offshore gambling company operating the Website at crakeng.com, together with any payment agents or group companies authorised to act on its behalf in relation to the services.
- Website means the online gambling platform branded as Kraken Casino in connection with crakeng.com, including any content, subdomains, mobile versions and historical or alternative access URLs that redirect to or frame crakeng.com, such as krakencasino.com or krakencasino.bet, where the contractual relationship remains with the Operator of crakeng.com.
- User or Player means any natural person who accesses the Website, whether or not they create an Account, and in particular any person who registers, deposits funds, places bets or otherwise participates in the Games.
- Account means a personal, individual user account created on the Website for the purposes of accessing the Games, depositing funds, placing bets and withdrawing winnings.
- Games means any casino games, slots, live-dealer games, virtual games or other betting products made available on the Website from time to time.
- Bet or Wager means any sum of money or monetary equivalent staked by a Player on the outcome of a Game or event offered on the Website.
- Bonus means any promotion, free spins, matched deposit, cashback, bonus money or similar incentive credited to an Account subject to specific terms and wagering requirements.
- Real Money Balance means the portion of funds in your Account derived from your deposits and cash winnings that are not subject to any wagering requirements.
- Bonus Balance means the portion of funds in your Account consisting of Bonuses and Bonus-derived winnings that are still subject to wagering or other promotional conditions.
- Payment Method means any deposit or withdrawal channel accepted on the Website, including but not limited to Visa/Mastercard, bank transfer, and supported cryptocurrencies such as Bitcoin and USDT (TRC20/ERC20), processed directly or through payment agents (including any Cyprus-based entity such as K-Services Ltd).
- Restricted Jurisdiction means any country or territory where online gambling with the Operator is prohibited by law, by the Operator's licence, or by the Operator's own internal risk policies, which currently include jurisdictions where a local licence would be required (including, without limitation, certain aspects of the United Kingdom regime).
- UK Resident means a person who is ordinarily resident in the United Kingdom, regardless of their nationality or temporary location.
- Chargeback means a requested or completed reversal of a card or payment transaction initiated by the Player or the Player's bank or payment provider.
Account Registration
By creating an Account on the Website, you confirm that you have carefully read these Terms and that you meet all eligibility criteria. You acknowledge that the Operator relies on the accuracy of the information you provide and that any breach may result in suspension or closure of your Account.
Eligibility and Age Verification
- Minimum age: You must be at least 18 years old (or the higher minimum age required in your jurisdiction) to open an Account and use the Website. The Operator strictly prohibits underage gambling.
- Self-exclusion schemes: If you are registered with a national self-exclusion scheme such as GamStop in the UK, you must not register or use the Website. The Website is not part of GamStop, so your self-exclusion will not automatically apply, and you remain solely responsible for complying with any self-exclusion commitments.
- Legal capacity: You must have full legal capacity to enter into binding contracts and must not be acting on behalf of any third party or for any commercial purpose.
- Restricted jurisdictions: You may not open or use an Account if you are located in, or a resident of, any Restricted Jurisdiction. It is your responsibility to ensure that your use of the Website is lawful in your country of residence and location.
Registration Process and KYC
- Account creation: To register, you must provide accurate personal details (including, at minimum, full name, date of birth, country of residence, email address and password) and confirm your acceptance of these Terms.
- Email verification: The Operator may require you to verify your email address by clicking an activation link. Unverified accounts may be suspended or limited until verification is completed.
- KYC documents: In accordance with anti-money laundering ("AML") and know-your-customer ("KYC") obligations under Curaçao law and international standards, the Operator may request documents such as government-issued identification, proof of address, source-of-funds evidence and payment method ownership proof. You must supply true, current and complete documents upon request.
- Data accuracy: You must ensure that all registration and profile data remains accurate and up to date. The Operator may request updated information at any time and may suspend your Account until satisfactory information is received.
Account Security and User Obligations
- Single account: You may hold only one Account on the Website. Multiple accounts, "cloned" accounts or accounts opened using aliases, false identities, VPNs or proxy IPs for the purpose of concealing identity or location are strictly prohibited.
- Password confidentiality: You are responsible for maintaining the confidentiality of your login credentials. You must not share your password, allow third-party access or use another person's Account. Any activity conducted through your Account will be deemed to have been carried out by you.
- Security measures: You must notify the Operator immediately if you suspect that your Account has been compromised, accessed without authorisation or used in any fraudulent manner. The Operator may reset passwords, freeze balances and perform security checks as reasonably required.
- AML and risk checks: The Operator may conduct ongoing monitoring of your Account, including transaction pattern analysis and affordability checks. This may result in temporary payment holds, request for additional documents, and in serious cases, closure of your Account and reporting to relevant authorities.
Betting & Gameplay Rules
The rules in this section govern how Bets are placed, accepted, settled and, where applicable, cancelled on the Website. By placing a Bet, you confirm that you understand and accept the rules of the relevant Game, as published on the Website or within the Game interface.
Placing Bets and Game Rules
- Game information: Each Game has its own rules, pay-tables and return-to-player ("RTP") information. You must familiarise yourself with these rules before placing any Bet. In the event of inconsistency, the specific Game rules prevail over these general Terms.
- Minimum and maximum stakes: Each Game and table has defined minimum and maximum stake limits. You may only place Bets within those limits. The Operator reserves the right to adjust limits at any time, including per-Player limits, to manage risk.
- Bet confirmation: A Bet is considered placed and accepted once it has been processed by the Website servers and appears in your Game history. The Operator's server-side records are decisive for all transactional matters.
- Prohibited conduct: You must not use any device, software, robot, or technique that enables automated play, cheating, collusion, card counting arrangements, advantage play exploiting technical flaws, or any other behaviour that gives you an unfair advantage.
Cancellation, Errors and Disconnections
- Bet cancellation: Once accepted by the server, Bets generally cannot be cancelled or modified by the Player. In cases of clear technical error, malfunction or incorrect Game configuration, the Operator may void or adjust affected Bets and either restore the stake or settle according to the corrected outcome.
- Misconfigurations and malfunctions: If a Game malfunctions, displays incorrect information, or operates in a way not intended by the Operator or the software provider, all affected Bets and winnings may be voided. The Operator's decision, based on server logs and provider records, is final.
- Disconnections: In the event of network interruptions or device failures on your side, Game results as recorded on the Operator's servers shall stand. You may be able to reconnect and resume unfinished rounds where the Game supports this functionality.
Live Casino, Chat Conduct and Fair Play
- Live environment rules: Live-dealer tables and chat functions are provided for entertainment and social interaction. You must treat dealers, staff and other Players with respect at all times.
- Prohibited behaviour: Abusive, racist, sexist, defamatory, threatening, fraudulent or otherwise offensive language or behaviour is strictly prohibited in live chat and across the Website. Promotion of other gambling sites, sharing personal contact details or attempting to collude with other Players is forbidden.
- Enforcement: The Operator may mute chat, remove you from tables, void Bets placed in connection with abusive or fraudulent behaviour, suspend or close your Account, and report serious incidents to regulators or law enforcement where appropriate.
Bonus Terms
Bonuses and promotions are offered at the Operator's discretion and are intended to enhance entertainment value. Each Bonus is subject to these general rules and any specific terms published on the Website or within promotional materials. In case of conflict, specific Bonus terms prevail.
Bonus Activation and Wagering Requirements
- Eligibility and opt-in: To receive a Bonus, you may be required to opt in, enter a bonus code or select the promotion at the time of deposit. Not all Players or jurisdictions are eligible for all promotions, and the Operator may restrict or revoke Bonus eligibility at its discretion.
- Wagering requirements: Unless expressly stated otherwise, Bonuses and any associated winnings must be wagered a specified number of times (for example, 35x the Bonus amount, or 35x the sum of deposit plus Bonus) before they become withdrawable. Progress towards wagering is calculated in accordance with the contribution table indicated in the promotion.
- Time limits: Each Bonus is valid for a limited period (for example, 7 - 30 days from the time of crediting). If wagering requirements are not met within the stated period, the Bonus and any Bonus-derived winnings may be forfeited.
Prohibited Games and Bonus Abuse
- Contribution restrictions: Certain Games may be excluded from Bonus wagering or contribute only a reduced percentage (for example, slots 100%, table games and live casino 10% or 0%). The contribution table is set out in the specific Bonus terms.
- Bet size limits: While a Bonus is active, maximum allowed Bet per spin or game round is typically capped (for example, at £5 or equivalent). Placing higher Bets may be considered Bonus abuse and result in the confiscation of Bonuses and winnings.
- Irregular play: The following activities are considered Bonus abuse: low-risk betting patterns, hedging Bets, playing with Bonus funds on high-variance features such as "bonus buys" where prohibited, or using Strategies specifically designed to trigger bonuses with minimal risk.
- Combining promotions: Unless explicitly permitted, Promotions cannot be combined. You may have only one active Bonus at a time, and attempting to stack Bonuses or to circumvent this rule may result in cancellation of all active Bonuses and associated winnings.
Bonus Management and Removal
- Bonus order of play: Unless stated otherwise, Bets are deducted from your Real Money Balance first and only then from your Bonus Balance. Winnings may be added to your Bonus Balance until wagering is completed.
- Cap on winnings: Some Bonuses may impose a maximum cap on convertible winnings (for example, a maximum of £500 in withdrawable winnings from a no-deposit Bonus). Any winnings above such cap may be forfeited when wagering is completed.
- Discretion to withhold: In cases of suspected Bonus abuse, breach of these Terms or use of fraudulent documentation, the Operator may refuse to credit a Bonus, remove an existing Bonus and seize associated winnings, and/or close the Account.
Payments & Withdrawals
This section sets out the rules governing deposits, withdrawals, fees and related banking practices on the Website. By initiating any transaction, you confirm that you are the lawful owner of the relevant Payment Method and that you understand the risks associated with offshore transactions and currency conversion.
Deposit Methods, Processing and Miscoding Risks
- Available methods: The Website supports selected Payment Methods which may include Visa, Mastercard, bank transfers and cryptocurrencies such as Bitcoin and USDT (TRC20/ERC20). Availability may vary by country and by time.
- Offshore processing: Deposits may be processed through offshore payment agents, including entities located in Cyprus (for example, "K-Services Ltd"). Your card statement may therefore display the name of such payment agent or a generic merchant descriptor not explicitly referencing gambling.
- Transaction description and disputes: Because of the way certain transactions are processed, card charges may appear under non-gambling categories (sometimes referred to as "miscoding"). This can affect your ability to raise disputes with your bank and may complicate chargeback requests. By depositing, you acknowledge and accept these risks.
- Minimum and maximum deposits: The Operator may set minimum and maximum deposit limits per transaction and per day. These limits will be displayed on the cashier page and may be adjusted at any time for risk management reasons.
Withdrawals, Pending Periods and Reversals
- KYC and verification: Before processing withdrawals, the Operator may require satisfactory completion of KYC and AML checks. This may include verification of identity, address and ownership of the Payment Method used for deposits.
- Processing times: The Operator aims to review withdrawal requests promptly; however, a standard "pending period" of up to 48 - 72 hours may apply during which your request is under review. After approval, crypto withdrawals may typically be processed within up to 3 - 7 business days, and bank transfers may take 10 or more business days, depending on intermediary banks and payment providers.
- Withdrawal reversal: During the pending period and subject to technical availability, you may have the option to cancel (reverse) a withdrawal request and return the funds to your Account balance for continued play. This feature is contrary to certain UKGC guidelines on responsible gambling. If you are a UK Resident or consider that withdrawal reversal may harm your financial wellbeing, you should not use this feature and may request that it be disabled where technically feasible.
- Method of payment: Withdrawals will, where possible, be made using the same Payment Method used for deposits. The Operator may, at its discretion and subject to AML requirements, choose a different method or request additional documentation.
Fees, Currency Conversion and Effective Costs
- FX conversion: If your Account or Payment Method is denominated in a currency not supported by the Website cashier (for example, GBP), deposits may be converted to EUR or USD at an exchange rate set by the Operator or its payment agents. This rate may differ from mid-market rates and can result in an effective cost of approximately 3 - 5% of the transaction value.
- Crypto spreads: For cryptocurrency deposits or withdrawals, the Operator or its payment agents may apply internal exchange rates or spreads that are less favourable than prevailing market rates, typically up to approximately 2% difference.
- Withdrawal fees: Bank wire withdrawals may be subject to a flat fee (for example, £30 or equivalent) for transfers below a specified threshold (for example, £500), in addition to any intermediary bank charges. The applicable fees will be displayed or made reasonably available before you confirm a withdrawal.
- Total effective cost: By combining FX conversion, crypto spreads and withdrawal fees, the total effective banking cost of using the Website may exceed 10% of your Player capital. You should carefully consider these costs before depositing.
Refunds, Chargebacks and Bet Reversal
- No automatic refunds: Bets placed and accepted on the Website are final and cannot be reversed or refunded except where explicitly provided in these Terms (for example, in the case of technical malfunctions).
- Chargebacks: You must not request a chargeback without first contacting the Operator to attempt to resolve any dispute. Unwarranted chargebacks may result in Account closure, deduction of fees and reporting to relevant agencies or databases.
- Bonus and winnings forfeiture: If you initiate a chargeback, the Operator may deduct the amount of the disputed transaction, along with any processing fees and related costs, from your Account balance and may void any Bonus and associated winnings.
Limitation of Liability
This section outlines the extent of the Operator's responsibilities and the limitations on liability arising from your use of the Website. It must be read together with other exclusions and warnings contained in these Terms.
Operator Obligations and Fairness
- Service provision: The Operator will use reasonable care and skill to operate the Website, to keep it available and to ensure that Games are run in a fair and impartial manner using certified random number generators or duly licensed live-dealer solutions.
- Accuracy of results: Game outcomes are determined by server-side logic and randomisation processes or by live games provided by third-party studios. In the event of a discrepancy between the outcome displayed on your device and that recorded on the Operator's servers, the server record shall prevail.
- Third-party providers: The Operator may rely on third-party software providers, payment processors and hosting services. While reasonable steps are taken to ensure their reliability, the Operator cannot guarantee their uninterrupted performance.
Exclusions of Liability
- Technical failures: To the maximum extent permitted by law, the Operator is not liable for any loss or damage arising from interruptions, delays, failures or corruption of data caused by network issues, hardware or software malfunctions, power failures or other technical problems outside its reasonable control.
- Unregulated UK access: If you access the Website from the United Kingdom, you acknowledge that the Operator is not licensed by the UKGC and that you do not benefit from UKGC protections, GamStop, IBAS or similar schemes. The Operator is not liable for any loss arising from the absence of such protections, without prejudice to any mandatory statutory rights you may have under UK consumer law.
- Financial risks: Gambling involves risk of losing money. You are solely responsible for assessing whether your financial position allows you to gamble. The Operator does not provide financial, legal or tax advice and is not liable for any financial difficulties, debts, credit rating issues or banking disputes resulting from your gambling activity.
Liability Cap and Non-Excludable Rights
- Liability cap: To the extent permitted by applicable law, the Operator's total aggregate liability to you for any claims arising out of or in connection with your use of the Website (whether in contract, tort, negligence or otherwise) is limited to the lesser of: (i) the amount of the Bet or transaction directly giving rise to the claim; or (ii) the total amount of Real Money you deposited into your Account in the six (6) months preceding the event giving rise to the claim.
- Excluded damages: The Operator is not liable for any indirect, consequential, special or punitive damages, including loss of profits, loss of opportunity, business interruption, data loss or reputational damage.
- Mandatory rights: Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be excluded under applicable law. If you are a UK consumer, nothing in these Terms affects your non-waivable statutory rights, although enforcing such rights against an overseas Operator may be practically challenging.
Intellectual Property Rights
All intellectual property rights in and to the Website and its content are owned by or licensed to the Operator and are protected by copyright, trade mark and other intellectual property laws.
Ownership and Permitted Use
- Content ownership: All software, source code, graphics, logos, trade names, trademarks, domain names, texts, interfaces, Game designs and other materials displayed or made available on the Website in connection with Kraken Casino and crakeng.com are the exclusive property of the Operator or its licensors.
- Limited licence: You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Website and Games for personal, non-commercial entertainment purposes only, strictly in accordance with these Terms.
Prohibited Uses
- No reproduction or distribution: You must not copy, reproduce, modify, adapt, translate, distribute, transmit, publicly display, publicly perform, publish, license, create derivative works from, or otherwise exploit any part of the Website or its content without the Operator's prior written consent.
- No reverse engineering: You must not reverse engineer, decompile, disassemble or otherwise attempt to derive source code from the software used in connection with the Website, except to the extent that such activity is expressly permitted by applicable law.
- Brand protection: You must not use the Kraken Casino name, logos or any marks associated with crakeng.com in any manner that may cause confusion, mislead other users or suggest an association with any other "Kraken" branded business (including the US-based cryptocurrency exchange).
Privacy & Data Protection
Your privacy and the protection of your personal data are important to the Operator. The collection, use, storage and sharing of your personal information are governed by the Website's Privacy Policy, which forms an integral part of these Terms.
- Reference to Privacy Policy: By using the Website, you acknowledge that you have read and understood the Privacy Policy published on crakeng.com and that all personal data you provide will be processed in accordance with it.
- Data processing: The Operator processes personal data for purposes including account administration, KYC/AML checks, fraud prevention, payment processing, promotion management and compliance with legal obligations in Curaçao and other relevant jurisdictions.
- UK and EU data subjects: If you are located in the United Kingdom or the European Economic Area, the Operator endeavours to process your personal data in line with the principles of the UK GDPR / EU GDPR, including respecting your rights of access, rectification and erasure, subject to applicable legal retention requirements.
Changes to Terms
The Operator may update or modify these Terms from time to time, for example to reflect changes in law, regulatory guidance, technical developments, Game offerings or internal policies.
Notification of Changes
- Methods of notice: Material changes to these Terms will, where reasonably practicable, be communicated to you by one or more of the following methods: (i) email sent to the address registered to your Account; (ii) on-site message or pop-up upon login; or (iii) a prominent banner or notice on the Website.
- Effective date: Unless a later date is specified, changes will take effect from the date indicated in the updated version of the Terms. The updated Terms will supersede all prior versions.
User Acceptance and Right to Discontinue Use
- Continued use: By continuing to access or use the Website after changes have taken effect, you are deemed to have accepted the updated Terms.
- Disagreement with changes: If you do not agree with any updated Terms, you must discontinue use of the Website, request the closure of your Account and withdraw any eligible Real Money Balance in accordance with these Terms.
Termination & Suspension
The Operator reserves the right to suspend or terminate your Account and access to the Website in the circumstances described below. Termination may impact your ability to access funds, Bonuses and Games, subject to applicable law and these Terms.
Grounds for Suspension or Closure
- Breach of Terms: The Operator may suspend or close your Account if you breach any provision of these Terms, including but not limited to Bonus abuse, multi-accounting, providing false information or engaging in prohibited gameplay.
- AML and fraud concerns: If the Operator suspects money laundering, terrorist financing, fraud, payment card misuse, chargeback abuse, or other criminal or improper activity, it may suspend your Account, freeze funds and request additional information, and may report the matter to competent authorities.
- Legal or regulatory reasons: The Operator may restrict service to certain jurisdictions or users where required by law, by its licence conditions or by internal risk assessment, including restrictions related to UK regulatory developments.
- Player-initiated closure: You may request your Account to be closed at any time by contacting customer support. The Operator will process such requests within a reasonable period, subject to completion of outstanding checks.
Consequences of Termination and Refund of Funds
- Balance handling: Upon termination that is not due to serious breach or fraud, the Operator will, subject to AML/KYC requirements, endeavour to refund your remaining Real Money Balance via an appropriate Payment Method. Bonus funds and Bonus-derived winnings may be cancelled.
- Confiscation rights: In cases of serious breach, fraud, criminal activity or unlawful use of the Website, the Operator may confiscate all or part of your Account balance, including winnings, to the extent permitted by law and licence conditions.
- Record retention: The Operator may retain your personal data, transaction records and communications after Account closure to comply with legal obligations, resolve disputes, enforce these Terms and for AML record-keeping requirements.
Governing Law & Jurisdiction
This section explains which law governs these Terms and how disputes between you and the Operator will be resolved. It reflects the offshore nature of the services and the limitations of regulatory oversight for UK Residents.
Applicable Law
- Curaçao law: These Terms, your Account and your use of the Website are governed by and shall be construed in accordance with the laws of Curaçao, without regard to conflict of law principles, except where mandatory laws of your country of residence provide otherwise and cannot be contractually excluded.
- UK consumers: If you are a consumer habitually resident in the United Kingdom, you may benefit from certain mandatory protections under UK consumer law. Nothing in these Terms affects those mandatory protections; however, enforcement against an offshore Operator may be challenging in practice.
Dispute Resolution and Complaints
- Internal complaints procedure: If you have a complaint, you must first contact the Operator's customer support using the channels set out in the "Contact Information" section. You should provide your Account details, a clear description of the complaint and any relevant evidence. The Operator will use reasonable efforts to investigate and respond within a reasonable timeframe.
- Escalation: If you are not satisfied with the resolution provided by the Operator, you may, where applicable, escalate the matter to the relevant authority or dispute resolution body in Curaçao in accordance with the instructions provided on the Website or on the Gaming Curaçao website, subject to its availability and procedures.
- No IBAS / UKGC oversight: You acknowledge that the Website is not covered by the UK Independent Betting Adjudication Service (IBAS) or overseen by the UKGC. Consequently, you cannot escalate disputes to IBAS or rely on UKGC alternative dispute resolution mechanisms in relation to the Website.
Courts and Arbitration
- Jurisdiction: Subject to any mandatory rights you may have to bring proceedings in your local courts (for example, as a UK consumer), any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Curaçao.
- Arbitration clause (where applicable): The Operator may, at its discretion and where permitted by law, propose to resolve disputes via arbitration in Curaçao or another agreed forum. Any such arbitration would be conducted in English under applicable procedural rules, and any award could be enforced in relevant jurisdictions, subject to local law.
